NOTICE from the State Fire Marshal and the Bureau of Fire Services

Clarification regarding fireworks being sold or stored at licensed retail locations in Michigan that are not consumer fireworks.

To: All Licensed Consumer Firework Retailers:

This notice is to inform all licensed Certified Consumer Fireworks Retail Sales (CFRS) locations that the sale or store of non-consumer fireworks at retail sales locations that have been certified/licensed by the Bureau of Fire Services is not allowed. The following items including professional display fireworks (1.3g) and pyrotechnic articles (including those marked 1.4g and “for professional use only”) are not allowed or permitted to be sold or stored at a CFRS location in Michigan.

The Michigan Firework Safety Act, Public Act 256 of 2011 and its adopted references and standards including NFPA 1124, prohibit the sale and related storage of professional display fireworks (1.3g) and pyrotechnic articles no matter how they are marked or labeled at any BFS licensed CFRS locations (refer to NFPA 1124, 2006 Section 7.2.4). The Bureau of Fire Services has researched this issue and sought guidance from members of the fireworks industry including The American Pyrotechnics Association.

From this date forward, if professional display fireworks 1.3g or pyrotechnic articles, including those marked or labeled as 1.4g and for “professional use only”, are found at a Michigan CFRS location, the items will be seized as evidence and civil fines will be issued. Repeated offenses can result in the revocation of any or all consumer sales certificates issued to that license/certificate holder.

It is the intention of the Bureau of Fire Services to provide oversight and regulation that supports safe, legal sales of compliant Consumer Fireworks 1.4 for consumers to purchase and use following the Michigan Firework Safety Act, PA 256 of 2011.
